1. Preamble
1.1 This Privacy Policy, hereinafter referred to as the “Policy”, sets out your rights and our obligations regarding the collection of certain personal information when you use the website, hereinafter the “Site”, made available to you by Boum d'Enchérir inc. / Bidboum inc., hereinafter “Bidboum”.
1.2 The purpose of this Policy is to inform you of Bidboum’s practices regarding the collection, use, and disclosure of personal information that may be obtained in connection with the services provided through the Site.
IT IS YOUR RESPONSIBILITY TO CAREFULLY READ THIS POLICY AND CONSENT TO IT BEFORE USING THE SITE.
1.3 By accessing the Site or using its features, as well as by expressing your consent in any other form, you, hereinafter “you” or the “User”, agree to be bound by the provisions of this Policy and the documents to which this Policy refers. This Policy binds you both during and after your use of the Site.
1.4 It is your responsibility to regularly read the entire Policy, as it may be updated at any time, and to systematically accept it before using the Site. It is your responsibility to review the entire Policy during your first use and during subsequent uses. The most recent version will always be available on the Site and will indicate the update date.
1.5 In order to use the Site, the User must also accept the Terms of Use, hereinafter the “Terms”, regarding their rights and obligations toward Bidboum.
1.6 The preamble forms an integral part of this Policy.

3. Automatic Collection of Information: What Data Collection Method Is Used by Bidboum?
3.1 Bidboum collects data related to your browsing on the Site and your use of the services offered on the Site through the various forms and questionnaires that we invite you to complete. The Site uses various cookies, which collect certain information relating to the User and their use of the Site.
3.2 Personal information will be collected, in particular, through the various forms that you complete on the Site, including when you use the Site’s features or participate in an auction.
3.3 It is also possible that data concerning you may be collected through your communications with Bidboum representatives. Communications that you initiate with Bidboum or one of its authorized representatives for this purpose constitute acceptance that data concerning you may be collected and shared for these purposes.
4. What Information Is Collected by Bidboum?
4.1 Depending on your interaction with the Site and the requests you make through it, the information that may be collected is strictly relevant and closely related to the services for which you deal with Bidboum.
4.2 Bidboum may therefore collect the following information relevant to the services offered through the Site:

All information relating to your payment method used to pay fees related to services purchased on the Site will be processed by an online transaction provider, https://www.paypal.com/ca/legalhub/paypal/privacy-full, as well as by its providers. Bidboum has no control or responsibility over the establishment of their privacy policies or terms of use. In this regard, before carrying out any transaction through the Site, Bidboum invites you to consult their privacy policies and terms of use by clicking the hyperlink above.
5. Use of Personal Information
5.1 The collection of such data allows Bidboum to:
| - | Provide the requested services, namely participation in auctions and the purchase of services offered by partners; |
| - | Offer a personalized service based on your preferences and browsing habits; |
| - | Maintain statistics to allow Bidboum to improve the services offered through the Site as well as its overall features; |
| - | Manage the customer relationship, communicate with the User, and respond to their requests; |
| - | Improve the operation of the Site; |

| - | Comply with applicable legal obligations; |
| - | Update the cybersecurity processes implemented to protect Site users’ data; |
| - | Obtain statistics regarding the services offered through the Site; |

5.2 The User understands that most browsers allow cookies to be refused or deleted. However, certain features of the Site may be affected.

6.1 Bidboum’s policy is to limit to the strict minimum the disclosure of your information collected through forms or through log files or cookies, for example. In this regard, Bidboum will not sell or rent your data to third parties for any purpose whatsoever.
6.2 The User acknowledges and consents that Bidboum may disclose certain information relevant to the performance of the services for which the User has used Bidboum’s services and the Site’s features, including, without limitation, to merchants and partners from whom the User has purchased services through the Site.
6.3 However, please be advised that Bidboum reserves the right to disclose information collected during your browsing on the Site in order to ensure compliance with any legal requirement and with our Terms of Use.
6.4 Certain service providers may also have access to the information collected if their services are required to ensure, among other things, the viability, functionality, and security of the Site, such as web hosting providers, the payment platform, IT services, and others.
6.5 Transfer of information outside Quebec: Certain service providers may be located outside Quebec or Canada. Providers outside Canada are the following:

7. Security Measures Implemented by Bidboum
7.1 The security measures implemented to ensure the sustainability of the Site’s infrastructure and the protection of the information obtained are a priority for us. For this reason, best practices aimed at data protection and cybersecurity are in place to prevent any breach in the computer system deployed to store your data. However, no security measure can guarantee a specific result in achieving this objective.
BY USING THE WEBSITE, YOU ARE DEEMED TO ACKNOWLEDGE AND ACCEPT THE EXTENT OF THE RISKS TO WHICH YOU ARE EXPOSED REGARDING YOUR PERSONAL INFORMATION.
YOU THEREFORE ACCEPT THAT THE SITE MAY BE SUBJECT TO CYBERATTACKS BY THIRD PARTIES OR MALICIOUS SOFTWARE INTENDED TO ILLEGALLY OBTAIN YOUR INFORMATION.
FOR THIS PURPOSE, YOU WAIVE ANY RECOURSE AND ANY CLAIM AGAINST BIDBOUM, ITS SUCCESSORS, SUBSIDIARIES, ASSOCIATED COMPANIES, DIRECTORS, SHAREHOLDERS, AND EMPLOYEES IN THE EVENT THAT YOUR PERSONAL DATA IS STOLEN OR ILLEGITIMATELY MISAPPROPRIATED WITHOUT ANY ENDORSEMENT BY BIDBOUM.
8. Access to Site Information by Users
8.1 In accordance with applicable legal requirements, Bidboum may grant a right of access to persons directly concerned by the information obtained through the Site. Any such request will be assessed and verified to ensure that the request is well-founded, in particular to prevent any fraudulent situation.
8.2 The purpose of such access requests is to allow consultation of the data, to request its correction, and even its complete deletion by the User, subject to data that must be retained by Bidboum to ensure the functionality of its services.
8.3 Users wishing to exercise these rights must contact the person designated in section 2 of the Policy.
9. Data Retention Period
9.1 All information, data, and records obtained through your use of the Site will be retained for the entire period during which you use the services offered through the Site. From the moment the user ceases to use the services offered through the Site, the data will subsequently be retained for a period of seven (7) full years. Upon expiry of this period, the information may be permanently deleted or anonymized in accordance with applicable laws.
10. Changes to the Policy
10.1 Bidboum reserves the right to modify this Policy at any time without any notice or other delay.
10.2 The User therefore accepts that the content of this Policy may be altered from one visit to another on the Site. The User is therefore aware that they must verify the Policy at each new consultation of our Site in order to ensure awareness of any new changes that may have occurred. Continued use of the Site and its services, after an initial acceptance of the Policy, constitutes a new acceptance of the Policy and of any changes that may have been made since your last visit.
11. Rights of Access and Rectification
11.1 The User may, at any time, contact the person responsible for applying the Policy, identified in section 2, to request confirmation of the personal information held by Bidboum and to request disclosure of that information.
11.2 If the User requests a copy, reasonable fees may be charged for the transcription, reproduction, or transmission of this information.
11.3 If personal information concerning the User is inaccurate, incomplete, or ambiguous, the User may require that it be corrected. The User may also directly modify the information concerning them in their user profile on the online platform.
11.4 The access request may also seek the complete deletion of the information collected, subject to data that must be retained by Bidboum to ensure the functionality of its services.
11.5 The person responsible for the protection of personal information must respond to an access or rectification request within thirty (30) days of the date of receipt of the request.
12. Right to Withdraw Consent
12.1 At any time, a User who has given consent to the disclosure or use of information collected in accordance with this Policy may contact the person responsible for applying the policy and protecting personal information on the Site to withdraw that consent. The User understands that by withdrawing consent, Bidboum will no longer be able to provide them with the Site’s services.
13. Links to Third-Party Sites
13.1 The Site may contain links to other websites. We are not responsible for the privacy practices of those sites.
13.2 We encourage you to consult their privacy policies.
14. Privacy Incidents
14.1 In the event of a privacy incident involving personal information, we will take reasonable measures to limit the risks of harm.
14.2 Where required by law, we will notify:

14.3 We also maintain a register of privacy incidents in accordance with legal requirements.
